The Urban Law Firm filed an amicus brief on behalf of numerous ERISA Trust Fund clients before the Washington Supreme Court requesting the Supreme Court overturn its prior precedent, which held ERISA Trust Funds could not use statutorily required payment, project, and license bonds to recover unpaid fringe benefit contributions. Today, the Washington Supreme Court issued its decision and overturned its prior precedent. ERISA Trust Fund across the State of Washington will be permitted to use payment, project, and license bonds for the recovery of unpaid fringe benefit contributions.
